Attorney Kurt Arnold

Kurt Arnold is one of the most skilled attorneys in the U.S. His accomplishments throughout his legal career are a testament to his creativity, relentlessness, and uncommon insight into complex areas of the law. He co-founded Arnold & Itkin LLP at 25 years old because he believed that hard working people deserved excellent legal representation when they faced dire circumstances.

What has resulted from his efforts are a long list of victories and record-breaking results, each one representing a life that was forever changed through Kurt’s work. These are made possible because Kurt refuses to back down when his clients’ lives are on the line. Between his attitude and his results, Kurt has earned a reputation for excellence in the courtroom and in settlement negotiation.

His perseverance has led to multiple verdicts larger than $10 million, over a dozen verdicts in the millions, numerous settlements in excess of $10 million, and hundreds of 7-figure settlements. Hundreds of lawyers across the U.S. have asked Kurt to try their cases because his skill and determination gets results.

Meet Kurt Arnold

All told, his accomplishments as a trial lawyer and negotiator have allowed Kurt to recover billions of dollarsfor his clients. Among these accomplishments is the largest single-plaintiff personal injury verdict in Louisiana’s history ($117 million), the leading commercial verdict in Hawaii’s history ($42 million), and the single-highest verdict for an amputee in the nation ($44 million). Kurt has also been instrumental in ensuring a defective product was recalled nationwide.

Perhaps one of the most important cases of Kurt’s career thus far was representing crew members of the Deepwater Horizon. In 2010, the oil rig Deepwater Horizon exploded, killing 11 and injuring dozens of the crew members. Nearly a third of them came to Kurt—27 workers facing one of the largest oil corporations in the world, needing his help to demand justice.

Kurt represented all of them successfully, serving more members of the Deepwater Horizon than any attorney in the U.S. He made sure that each and every worker than came to him was taken care of for the rest of their lives. Kurt’s passion for maritime workers has made him a nationally-recognized authority in admiralty law and oilfield cases. National and high-profile news organizations often consult Kurt when offshore or oil industry disasters occur, including CNN’s Anderson Cooper, who featured Kurt as a guest.

In a relatively short time as an attorney, Kurt has achieved more for his clients and seen more time in front of a jury than most lawyers achieve in their entire lives. At only 34, he was selected to the Texas Super Lawyers® 2013 list, one of the youngest attorneys in Texas to be honored with that achievement. He was included again from 2014 to 2017. He has also been named to the Top 100 list of Texas Super Lawyers in 2017, as well as the Top 100 list of Houston Super Lawyers from 2015 to 2017. He was also included in the “Top 40 Under 40” lists written by both the Houston Business Journal and the National Trial Lawyers, and he was recognized as a “Top 100 Trial Lawyer” by the National Trial Lawyers.

Past awards also include being made a member of the Million and Multi-Million Dollar Advocates Forum®, named as a Founding Member of the Nation’s Top 100 Attorneys according the National Association of Distinguished Counsel, inclusion in The Best Lawyers in America® for Admiralty and Maritime Law and Personal Injury Litigation - Plaintiffs, and selection as one of the 2015 Elite Trial Lawyers 50 firms. He has also founded the Texas Association of Consumer Lawyers and continues to share his trial insight and experience with the Texas State Bar alongside other elite trial lawyers.

Kurt’s educational career was as auspicious as his legal career. He finished his undergraduate degree at only age 19 with High Honors at the University of Texas, and pursued a law degree at UT as well. He received his Juris Doctorate in the top 10% of his class with Honors, immediately beginning work at a litigation firm in Houston. He eventually moved on from this firm to found Arnold & Itkin LLP at only 25. He is currently licensed to practice in both Texas and Pennsylvania, as well as in the U.S. Supreme Court; the Southern, Eastern, Western, and Northern District of Texas in U.S. District Court; and before the Fifth, Second, and Third Circuit Court of Appeals.

Ambulance Accident Victim Wins $117 Million

The attorneys at Arnold & Itkin were able to successfully see this case to a verdict for their injured client.

Arnold & Itkin LLP took on the case of a woman who was injured back in 2010. The woman was pregnant at the time and started experiencing severe stomach pains. The woman called an ambulance to take her to the emergency room. Acadian Ambulance showed up shortly after to transport her. Little did the woman know that the driver of her ambulance had a poor driving record as well as bad eye sight. On their way to the hospital, the driver dropped his RSI device on the ground and proceeded to pick it up. He took his eyes completely off of the road to grab it and while he was doing so, drove directly into the back of a sugar cane truck. The woman's spine was severed in the accident and also suffered severe brain trauma. She will never be able to fully recover and is bound to a wheel chair for the remainder of her life.

At the time the verdict was reached, the woman had already been forced to pay medical bills over $1.4 million. Over the course of the woman's future, this would total to about $30 million. Also a tragic component to the accident, the woman's unborn child was born prematurely. Although she was delivered healthy, doctors are concerned that she may suffer health side effects as a result of the premature birth. Since the mother has no capacity to care for her daughter or the daughter that she had prior to the accident, they both have to live with their grandmother. The attorneys at Arnold & Itkin petitioned that the victim as well as her two daughters deserved compensation for this gross act of negligence. When the verdict was reached, she was awarded $117 million.

$18.5 Million Jury Verdict Granted in Second Williams Geismar Trial

Thanks to the representation of Arnold & Itkin, 4 workers who were injured in the 2013 Geismar explosion receive a substantial verdict.

The jury in our second trial against Williams Companies, Inc. on behalf of our injured clients handed down a verdict of $18.5 million—a collective number accounting for the compensation our four clients received. Our clients were represented by Attorneys Kurt Arnold, Kyle Findley, and Kala Sellers, three of the many dedicated and passionate attorneys on our team. In total, we have won over $30 million in compensation in just two trials against those responsible for our clients’ injuries sustained from the Geismar explosion, and we will persist in earning more victims these kinds of verdicts. In this particular case, we were able to also prove fault in Sabic Petrochemical, a part owner of the plant at the time of the explosion. Our team will continue to investigate parties responsible and hold them accountable for our clients who have wrongfully suffered depilating injury in this horrific event.

$15.4 Million Jury Verdict Won for Injured Workers from 2013 Williams Olefins Explosion

Our team secured a massive verdict for workers who were injured in a devastating explosion caused by negligence.

In a powerful victory for our clients, Attorneys Kurt Arnold, Kyle Findley, and Kala Sellers won a verdict of $15,458,434.32 for our four clients, all of whom were injured while working at a Williams Olefins plant in Geismar. The plant was undergoing a $400 million expansion project, but operations at the plant continued—despite numerous sources agreeing that this would be incredibly risky and dangerous for the plant workers. Rather than shut the plant down for a few months, the CEO and board of directors ignored the safety recommendation and ordered operations to continue.

During the expansion project, a reboiler over-pressurized and exploded. The blast could be seen for miles, and it injured our clients—4 workers who had to run for their lives and suffered physical and psychological damage as a result. The parent company for the plant, Williams Companies, Inc., blamed the incident on the holding company, Williams Olefins LLC. Shifting the blame would limit their responsibility for the incident, which would also limit the compensation that could be sought against them. Our attorneys, who have vast experience with plant operations, sorted through hundreds of thousands of documents to find that the pressure relief valve on the reboiler was not opened.

Our attorneys found that numerous audits and safety warnings were issued regarding the unopened valve, but the necessary repair was never made. We also found evidence that demonstrated that the Defendants had “substantial certainty” that an explosion would occur without repair. This certainty helped our clients seek compensation beyond the limits imposed by workers’ compensation. Our firm also demonstrated that Williams Companies, Inc. had control over plant operations and were the true employers of the plant’s managers and workers.

During three weeks of trial, the Defendants attempted to shield themselves with the statutory employer defense. They placed the blame on Williams Olefins LLC, but the jury saw through their maneuver. In the end, the Plaintiffs received an award judgment in their favor.

The jury placed the vast majority of the blame (95%) at the feet of Williams Companies, Inc. Just 3% was placed with Williams Olefins LLC, but both were found to have “substantial certainty” about the incident. More importantly, the jury found that the plant managers were actually employees of Williams Companies, not Williams Olefins LLC—which soundly defeated their defense strategy.

Ultimately, our clients received the compensation they needed to recover. Shawn Thomas ($9.4 million), Christopher Devall ($3.6 million), Eduardo Elizondo ($360,000), and Michael Danton ($205,000) have all received the support they need to heal physically and emotionally, giving them the fresh start they need. The total award included both the initial judgment ($13,679,933.53) with pre-judgment interest added to it as well ($1,778,409.79).

Arnold & Itkin is proud to have helped these men get the compensation they needed. We are also proud to be representing nearly 100 workers in upcoming trials alongside Clayton, Fruge, and Ward. The case was filed in Iberville Parish, Louisiana, and was presided over by the Honorable Elizabeth Engolio.
