Last week, a deadly explosion occurred in West, Texas claiming the lives of dozens of individuals, and injured about 200 in the small community of 2,800 people. According to local Waco news reports, a third lawsuit has been filed by an injured victim from the explosion that caused severe pain and suffering throughout the town of West. This suit was filed by a grandmother who argues that her injuries are a direct result of the "conscious indifference" to the local community by how they were storing toxic chemicals and other hazardous materials on a site so close to the residents nearby.
This grandmother claims that during the time of the explosion, she was at the public park not far away from the plant location. When the explosion took place, this woman claims that she sustained injuries including a
broken jaw bone, loosened teeth, a perforated ear drum from thesound of the blast as well as
hearing loss. Within this lawsuit also explains that
property damage that her house incurred from the blast, as it was listed to be within the blast radius of the plant. While her home suffered from only damages, there were many residents who completely lost their homes from the explosion as a large number of homes and businesses were leveled out by the blast.
Much discussion has been focused on the fact that the plant had not been under inspection by OSHA (Occupational Safety and Health Administration) since 1985, and this is the exact point that the plaintiff is addressing in the complaint. Prior to the grandma's lawsuit, another two had been filed similar to hers. The first lawsuit was filed by four different insurance companies listing the co-defendants as Adair Grain (the parent company) and West Fertilizer, Co. Their goal is to seek compensation for the real and personal property damages as well as lost profits due to the negligent acts of the defendants. The other suit was filed by a woman who claims she lost every worldly good she had in the blast; she is without even a car now. This claim also includes that the woman and her minor child were injured as a result of the blast and they are seeking an undisclosed amount.
