$76.6 Million Awarded to Boy Who Grew Female Breasts from Risperdal

A young boy who had developed female breasts as a result of taking Risperdal—a
drug manufactured by Johnson & Johnson and Janssen Pharmaceuticals—was
awarded a $76.6 million jury verdict. Represented by Attorneys Jason Itkin
and Kyle Findley of Arnold & Itkin, with help from Santana McMurrey
and Cory Itkin, the client was able to successfully hold Johnson &
Johnson and Janssen Pharmaceuticals accountable for their failure to disclose
the drug’s harmful side effects.
Once the boy’s family sued Johnson & Johnson for his symptoms
related to Risperdal—an anti-psychotic medication—Johnson
& Johnson maintained that the boy remained on the drug after knowing
about the side effects, that this drug was the only one that worked, and
that the drug did not have any ties to gynecomastia in young males. Through
cross-examination, evidence that became known as “Tab 4,”
showed that there was scientific data evidencing a link between Risperdal
and gynecomastia. Furthermore, it was evidenced that Johnson & Johnson
kept this information secret from scientific published studies, the FDA,
At the end of the 11-day trial, the jury awarded Arnold & Itkin’s
client $76.6 million after unanimously finding Johnson & Johnson and
Janssen Pharmaceuticals to be guilty of failing to warn consumers against
the dangerous side effects of the drug. This verdict is the largest single
verdict in a Risperdal-Gynecomastia case.

of one of his legs. While on the job, the longshoreman became the sole
casualty of an industrial crane accident. The defendant blamed the worker

Our firm filed a case in Harris County, TX on behalf of a man who suffered back injuries serious enough to warrant two surgeries for treatment. We ultimately recovered $2,950,000 on his behalf.

Georgia seaman who was injured while aboard a pipe-laying vessel docked
in Mississippi. At the time of the injury, he had been attempting to open
a drawer of a work cabinet. Because the drawer lacked a drawer stop, it
began to fall; our client injured his back in an attempt to catch it.
Those injuries ultimately required our client to undergo two surgeries.

injury severe enough to require surgery after her tugboat hit another
vessel. In the aftermath of the collision, both vessel owners denied liability,
choosing to instead blame the other vessel. They also attempted to minimize
our client’s injuries—arguing her claim was not credible,
her medical bills were overstated, and that she was indeed able to return
to work. Utilizing the Limitation of Liability Act, they also attempted
to cap their damages. This effort was blocked when Cory Itkin won in federal
court trial. After, we reached a favorable settlement just before the
second trial for damages was to begin in state court.

Injured Refinery Worker Recovers $1.72 Million Verdict
Arnold & Itkin attorneys stood by the side of an injured refinery worker in a case that spanned four years – eventually recovering $1.72 million on his behalf.
For four years, Attorney Cory Itkin stood by an injured refinery worker,
Ernesto Tamez and his wife as they sought justice. Mr. Tamez had been
employed in Texas City, Texas at a BP refinery when a crane operator hit
him with a heavy oil burner, trapping him between the machine and a guard
rail. The plaintiff sustained serious injuries to his back, neck and shoulder.
A case was filed against Maxim Crane Workers who argued that not only
was the accident caused by the plaintiff, but that the injuries were exaggerated
– stating that many of them could be attributed to "wear and
tear" from age. Neither the plaintiff nor his wife spoke English,
but the firm was not deterred and ensured a translator was present to
help them testify. The trial lasted a week in Galveston, TX before the
Honorable David E. Garner. The jury came back stating that the employer
was 100% responsible; the plaintiff received $1.72 million.

$1,500,000 Jury Verdict Recovered in Wrongful Death Lawsuit
Arnold & Itkin obtained $1.5 million for a family who lost a loved one due to dangerous working conditions at a UPS warehouse.
Cory Itkin and Ryan MacLeod of Arnold & Itkin argued and won a case
in Harris County that found UPS had acted with gross negligence, not just
ordinary negligence, in creating dangerous working conditions that led
to the death of a young man who worked in one of their warehouses. The
UPS worker suffered a cardiac arrhythmia while working in a warehouse
that wasn’t air-conditioned during the heat of summer. UPS argued
that the young man was already known to have a serious heart condition
since birth, and that the man had worked there for the past six years
and knew the working conditions, which were typical for UPS warehouses.
Before trial, they offered the bereaved family no more than $150,000.
Arnold & Itkin was able to obtain the unanimous verdict needed to
deem that UPS was responsible for dangerous working conditions due to
their gross negligence, securing $1.5 million in compensation for the
surviving family members.
$1.5M Recovered for Victim of Barge Collision
After a barge collided with a dock, an injured dock operator turned to Attorney Cory Itkin for help. We beat back the claims raised by the tugboat company and were successful in reaching a $1.5 million settlement.

a dock operator who sustained injuries that required neck surgery after
a barge collided with a dock. The tugboat company claimed there was minimal
impact from the collision, our client worked for nearly a year after the
crash, and had been in a vehicle accident the day prior. Despite these
defenses, we reached a favorable settlement to help him move on.
