Arnold & Itkin LLP took on the case of a woman who was injured back in 2010. The woman was pregnant at the time and started experiencing severe stomach pains. The woman called an ambulance to take her to the emergency room. Acadian Ambulance showed up shortly after to transport her. Little did the woman know that the driver of her ambulance had a poor driving record as well as bad eye sight. On their way to the hospital, the driver dropped his RSI device on the ground and proceeded to pick it up. He took his eyes completely off of the road to grab it and while he was doing so, drove directly into the back of a sugar cane truck. The woman's spine was severed in the accident and also suffered severe brain trauma. She will never be able to fully recover and is bound to a wheel chair for the remainder of her life.
At the time the verdict was reached, the woman had already been forced to pay medical bills over $1.4 million. Over the course of the woman's future, this would total to about $30 million. Also a tragic component to the accident, the woman's unborn child was born prematurely. Although she was delivered healthy, doctors are concerned that she may suffer health side effects as a result of the premature birth. Since the mother has no capacity to care for her daughter or the daughter that she had prior to the accident, they both have to live with their grandmother. The attorneys at Arnold & Itkin petitioned that the victim as well as her two daughters deserved compensation for this gross act of negligence. When the verdict was reached, she was awarded $117 million.

on the job. His employers were initially unwilling to negotiate with Arnold
& Itkin, claiming that the man was responsible for the wounds he received.
However, we were able to show that the corporations were liable for the
suffering our client endured. In the end, the companies took responsibility
for their actions and paid for their negligence. As a result, the client
and his family no longer have to worry about the medical bills that were

$76.6 Million Awarded to Boy Who Grew Female Breasts from Risperdal
Arnold & Itkin obtained the largest single verdict in a Risperdal-Gynecomastia case—$76.6 million. We are honored to have helped our client recover this amount!
A young boy who had developed female breasts as a result of taking Risperdal—a
drug manufactured by Johnson & Johnson and Janssen Pharmaceuticals—was
awarded a $76.6 million jury verdict. Represented by Attorneys Jason Itkin
and Kyle Findley of Arnold & Itkin, with help from Santana McMurrey
and Cory Itkin, the client was able to successfully hold Johnson &
Johnson and Janssen Pharmaceuticals accountable for their failure to disclose
the drug’s harmful side effects.
Once the boy’s family sued Johnson & Johnson for his symptoms
related to Risperdal—an anti-psychotic medication—Johnson
& Johnson maintained that the boy remained on the drug after knowing
about the side effects, that this drug was the only one that worked, and
that the drug did not have any ties to gynecomastia in young males. Through
cross-examination, evidence that became known as “Tab 4,”
showed that there was scientific data evidencing a link between Risperdal
and gynecomastia. Furthermore, it was evidenced that Johnson & Johnson
kept this information secret from scientific published studies, the FDA,
At the end of the 11-day trial, the jury awarded Arnold & Itkin’s
client $76.6 million after unanimously finding Johnson & Johnson and
Janssen Pharmaceuticals to be guilty of failing to warn consumers against
the dangerous side effects of the drug. This verdict is the largest single
verdict in a Risperdal-Gynecomastia case.

Richard Foreman, a Houston investor, was aiming to acquire one of Hawaii's biggest lumber suppliers, Honsador Lumber Corporation, when that plan was intentionally interfered with by Key Principal Partners LLC and its parent company Key Corporation. A jury found them guilty of breaching their fiduciary duties and interfering as well as violating Hawaii's unfair competition statute. A $41 million verdict was won on behalf of Foreman. $39.7 Million Verdict Won for Burn Injury Victim
Attorneys Kyle Findley, Kala Sellers, and Adam Lewis recovered a $39.7 million verdict on behalf of a worker who was severely injured in a dust fire and explosion at a Texas plywood plant.
On April 26, 2014, a dust collection system, along with its related safety
systems, failed—leaving the baghouse of a Georgia-Pacific plywood
plant in Corrigan, TX vulnerable. When a fire ignited in the system, sparks
were sent through the ductwork, which the system failed to prevent from
entering the baghouse. An explosion and deflagration occurred, resulting
in a fire that engulfed our client who had been unknowingly standing nearby.
Our client suffered significant burn injuries in the blast; however, despite
the severity of his injuries, he worked to alert emergency services. He
was later transported to a Tier 1 burn unit in Houston, TX via life flight
helicopter—but only after he had confirmed that his co-workers had
been sent for treatment. At the time of the trial, he had already undergone
seven surgical procedures. He is projected to receive many more.

fought to ensure that our client was properly compensated. We took the
case to trial, which lasted over a three week period. During that time,
our legal team fought to prove that the dust collection system, which
had been designed by Aircon, Inc., was unsafe and therefore failed to

in an unsafe location.
After deliberating, the jury found that both of the defendants were negligent
for an unsafe design, as well as failing to warn the plant of the associated

The jury in our second trial against Williams Companies, Inc. on behalf
of our injured clients handed down a verdict of $18.5 million—a
collective number accounting for the compensation our four clients received.

Kala Sellers, three of the many dedicated and passionate attorneys on
our team. In total, we have won over $30 million in compensation in just
two trials against those responsible for our clients’ injuries sustained
from the Geismar explosion, and we will persist in earning more victims
these kinds of verdicts. In this particular case, we were able to also
prove fault in Sabic Petrochemical, a part owner of the plant at the time

$15.4 Million Jury Verdict Won for Injured Workers from 2013 Williams Olefins Explosion
Our team secured a massive verdict for workers who were injured in a devastating explosion caused by negligence.
In a powerful victory for our clients, Attorneys Kurt Arnold, Kyle Findley,
and Kala Sellers won a verdict of $15,458,434.32 for our four clients,
all of whom were injured while working at a Williams Olefins plant in
Geismar. The plant was undergoing a $400 million expansion project, but
operations at the plant continued—despite numerous sources agreeing
that this would be incredibly risky and dangerous for the plant workers.
Rather than shut the plant down for a few months, the CEO and board of
directors ignored the safety recommendation and ordered operations to continue.
During the expansion project, a reboiler over-pressurized and exploded.
The blast could be seen for miles, and it injured our clients—4
workers who had to run for their lives and suffered physical and psychological
damage as a result. The parent company for the plant, Williams Companies,
Inc., blamed the incident on the holding company, Williams Olefins LLC.
Shifting the blame would limit their responsibility for the incident,
which would also limit the compensation that could be sought against them.
Our attorneys, who have vast experience with plant operations, sorted
through hundreds of thousands of documents to find that the pressure relief
valve on the reboiler was not opened.
Our attorneys found that numerous audits and safety warnings were issued
regarding the unopened valve, but the necessary repair was never made.
We also found evidence that demonstrated that the Defendants had “substantial
certainty” that an explosion would occur without repair. This certainty
helped our clients seek compensation beyond the limits imposed by workers’
compensation. Our firm also demonstrated that Williams Companies, Inc.
had control over plant operations and were the true employers of the plant’s
managers and workers.
During three weeks of trial, the Defendants attempted to shield themselves
with the statutory employer defense. They placed the blame on Williams
Olefins LLC, but the jury saw through their maneuver. In the end, the
Plaintiffs received an award judgment in their favor.
The jury placed the vast majority of the blame (95%) at the feet of Williams
Companies, Inc. Just 3% was placed with Williams Olefins LLC, but both
were found to have “substantial certainty” about the incident.
More importantly, the jury found that the plant managers were actually
employees of Williams Companies, not Williams Olefins LLC—which
soundly defeated their defense strategy.
Ultimately, our clients received the compensation they needed to recover.
Our clients won four separate awards for $9.4 million, $3.6 million, $360,000,
and $205,000. They have all received the support they need to heal physically
and emotionally, giving them the fresh start they need. The total award
included both the initial judgment ($13,679,933.53) with pre-judgment
interest added to it as well ($1,778,409.79).

Attorneys at Arnold & Itkin secured $14 million for their client who sustained serious head injuries on barge.
A seaman sustained serious head injuries after being struck on the head by a three-foot pipe. The incident took place in Lake Washington, Louisiana on the inland barge Hercules 15. The pipe had been tack welded to the derrick but was not removed again before drilling operations resumed. The pipe was jarred loose at which point it hit the Plaintiff on the head. The case was filed in the Galveston County Court in March of 2008, and although the trial was scheduled for February 2, 2009, the entire case settled for $14 million just two days prior.
